The dispute resolution boards are impartial decision-making bodies established during the term of continuing contracts, and they are responsible for resolving any conflicts arising during the execution of the contract. The establishment of such committees is in keeping with the promotion promoted by the Code of Civil Procedure for the adoption of extrajudicial means of dispute resolution. Among the right-to-treat relationships is judicial reorganization, which may be converted into bankruptcy in the event that conflicts arise that are substantially aggravated. From the adoption of dispute to recovery, however, credit and debtor subjects tend to adopt a strategic view, foreseeing the best performance on the opposite side and acting in a way that will bring them the highest possible payoff, according to the application of Game Theory. . Thus, the present study intends to analyze the application of dispute boards, as a preventive mode of conflicts, in the context of judicial recovery, in order to verify the relevance of this institute for the achievement of the Recovery Plan, under the temporal and economic aspects. Throughout such analysis, Game Theory, a concept inherent in the Economic Analysis of Law, will allow us to verify the behavior of economic agents, who tend to adopt a strategy of game, aiming to obtain the best results, in view of the implementation of such committees. |
