Resumo:
The purpose of the text is to interweave the sabers arising from Communication and Law, with special emphasis on the offer of production of meanings present in the journalistic texts about the prison population in the State of Tocantins, in keeping with the respect for the fundamental rights of the human person. Specifically, the research focuses on the existing problem of contradictory positions of the media groups, with emphasis on the representatives of journalism in the face of critical events with people imprisoned in the Tocantins prison system. The force of production, offer and dissemination of meanings is perceived by the journalistic narratives in the face of events, especially the escape from prison spaces, which can interfere with what we have and defend ourselves, constitutionally, as freedom of the press. In the empirical world, other grammars are created to interpret and narrate events with other intentions, which may harm the legal and very personal rights of those arrested. The objectives of the study focus on the analytical theoretical understanding of the relationship between communication and the right to freedom of the press in force in the 1988 Constitution, with a focus on the events of escape from incarcerated people. The study has a qualitative bias, in the search for knowledge and understanding of the theme proposed for analysis. It also uses documentary research, that is, the legal-constitutional order of Brazilian historiography, government documents and specific councils for prison spaces: National Council of Justice, National Penitentiary Department, Penitentiary and Prision Department of Tocantins – DEPEN/TO, National Council for Criminal and Penitentiary Policy; and documents produced by the Brazilian Press Association and Reportes San Frontiéres. Bibliographic research has surrounded scholars and researchers who stick to the relationship between communication and law, gaining prominence, Dominique Maingueneau, Norberto Bobbio, Michel Foucault.
