The communicative competence if manifests with the capacity of identifying, interpret and transmit the messages set pronounced by the participants of the Mediation action. The interpretative competence is the capacity of interpreting the speakers intentions with the purpose of recognizing requests and needs. Both competences are constituted of abilities and attitudes. So, that way some competences can provide the pressures free communicative action development of private interests? To answer this question it accomplished comparisons between mediator activities and the categories habermasians with a view to form a comparative board and to stress abilities and attitudes that compose the talkative competence and the interpretative. The comparison revealed that people load 'universal terms' to if arrive to the understanding in a speech situation; That when searching the Mediation as conflicts resolution method people load a predisposition to the mutual understanding; That the Mediator work will reach the success if it is enabled with other competences inspired in the categories habermasians; That the Mediation process is contaminated by a rationality technique-instrumental that if manifest in the goal of the Courts in decrease the lawsuits, in the efficiency front search to the organs controllers and in the Mediator practice that uses the technique and the instrumentation to "obtain" consensus success; That the conflicts resolution consensual method, the Mediation, provides a communicative attitude and that the Mediator role is the one of stimulating the communication. O objetivo desta dissertação é criar um conjunto de competências, habilidades e atitudes, denominadas de competências comunicativas e interpretativas, inspiradas nas categorias da Ação Comunicativa de Habermas, ação comunicativa, o agir estratégico e o entendimento mútuo, para fomentar as atividades do Mediador de Conflitos. A competência comunicativa se manifesta como a capacidade de identificar, interpretar e transmitir o conjunto de mensagens proferidas pelos participantes da ação de Mediação. A competência interpretativa é a capacidade de interpretar as intenções dos falantes com a finalidade de reconhecer pedidos e necessidades. As duas competências são constituídas de habilidades e atitudes. Então, de que maneira certas competências podem proporcionar o desenvolvimento da ação comunicativa livre das pressões de interesses particulares? Para responder esta pergunta realizou-se comparações entre as atividades do Mediador e as categorias habermasianas com a intenção de formar um quadro comparativo e ressaltar habilidades e atitudes que compõem a competência comunicativa e a interpretativa. A comparação revelou que as pessoas carregam ‘condições universais’ para se chegar ao entendimento em uma situação de fala; que ao procurar a Mediação como método de resolução de conflitos as pessoas carregam uma predisposição ao entendimento mútuo; que o trabalho do Mediador alcançará o sucesso se for capacitado com outras competências inspiradas nas categorias habermasianas; que o processo de Mediação é contaminado por uma racionalidade técnica-instrumental que se manifesta no objetivo dos Tribunais em diminuir os números de processos, na busca da eficiência frente aos órgãos fiscalizadores e na prática do Mediador que utiliza a técnica e a instrumentação para “obter” sucesso do consenso; que o método consensual de resolução de conflitos, a Mediação, proporciona uma atitude comunicativa e que o papel do Mediador é o de estimular a comunicação. 2017-03-24T13:39:04Z 2017-03-24T13:39:04Z 2017-01-30 Dissertação SILVA, Osnilson Rodrigues.
