The Rule of Law is, so to speak, what guarantees the protection/security of citizens and, also, the same that affronts fundamental freedoms. Reason of State and Emergency Democracy play, at the same time, an important political role in this liberal-democratic constitutional framework in the face of the threats of international terrorism. The world, in terms of the security apparatus, is no longer the same after that morning of September 11, 2001. Permanent surveillance policies, among other instruments, were implemented in several countries, mainly in the United States of America, to prevent new terrorist attacks happen. Among these security policies, in times of terrorist crisis, it is clearly perceived that the ruler, representative of the executive power, through emergency powers granted by the legislature, can use all available and appropriate resources for the conservation of the state apparatus as all. This investigation argues around the maintenance of state security in the face of the reduction of public liberties in the fight against international terrorism, through the analysis of government documents from the main authorities involved in the planning of the security doctrine of the United States of America, France, the European Union and the United Nations regarding the war on terror and drawing a relationship between these actions and the precepts theorists of the idea of reason of state. O Estado Democrático de Direito, hodiernamente, apresenta duas facetas: de um lado, constitui-se no órgão responsável por garantir a manutenção da segurança nacional juntamente com a promoção da paz e, por outro lado, torna-se uma ameaça direta às liberdades civis quando essa mesma segurança estatal é ameaçada por grupos terroristas ou indivíduos. O Estado de Direito é, por assim dizer, o que garante a proteção/segurança dos cidadãos, mas é também o mesmo que afronta as liberdades fundamentais. A razão de Estado e a Democracia de Emergência exercem, contemporaneamente, papel político importante nesse quadro constitucional democrático-liberal defronte às ameaças do terrorismo internacional. O mundo, em termos de aparato securitário, não é mais o mesmo depois daquela manhã de 11 de Setembro de 2001. Políticas de vigilância permanente, dentre outros instrumentos, foram implantadas em vários países, principalmente nos Estados Unidos da América e na França, para evitar que novos ataques terroristas acontecessem. Dentre essas políticas de segurança em tempos de crise terrorista, percebe- se, claramente, que o governante, representante do poder executivo, por meio de poderes emergenciais concedidos pelo poder legislativo, pôde utilizar todos os recursos disponíveis e cabíveis para a conservação do aparato estatal como um todo. Esta tese argumenta em torno da manutenção da segurança estatal diante da redução das liberdades públicas no combate ao terrorismo internacional, por meio da análise de documentos governamentais das principais autoridades envolvidas no planejamento da doutrina de segurança dos Estados Unidos da América, França, União Europeia e Organização das Nações Unidas no que se refere à guerra contra o terror, traçando uma relação dessas ações com os preceitos teóricos da ideia de razão de Estado. 2023-03-13T12:11:49Z 2023-03-13T12:11:49Z 2023-01-24 Tese CARDOSO, Marco Aurélio.
