This research aims to analyze and problematize the conditions related to the history and legislation that support the rights of the black person in Brazil, focusing on the 20th century and on previous legislation. The main objective is to question the strength, structure and reflexes of the legislation that protect the rights of black people in Brazil, in contrast to anti-racist education and social conscience. In this vein, it is also possible to reflect on the contributions of black people in the fight for their rights and freedoms, and on the importance of an anti-racist education that aims to repair these institutional erasures. This dissertation is developed through the methodology of bibliographic research presented for both a narrative within the concentration area that is based on linguistic studies and on the line of research: text, discourse and history, approaching the theories of text and discourse and their relationships with the story. Therefore, the research was developed and based on legislation such as the Letter Lei/1824); (Federal Constitution/1988); (Law No. 7,716/1989); (Law No. 9,029/1995); (Law No. 9,459/1997); (Law No. 10.639/2003); (Law No. 12,288/2010); (Law No. 12,711/2012); (Law nº 12.990/2014) among other legal provisions, and in authors references on the subject such as (LIMA and MUSARRA, 2022) that deals with (Dis)Advances: anti-racist legislation and its application; (DUARTE and NUNES 2020) Writing: the writing of us; (PRUDENTE, 1988) The black person in the Brazilian legal system; (CRUZ,2014) Anti- racist Education: Reflections on curriculum and pedagogical practice in municipal schools in Paulistana – PI; (CRUZ, 2020) Anti-racist decolonial pedagogy Pedagogical actions for a possible construction; (CARNEIRO, 2011) anti-racist education and practices in the classroom: a question of teacher training Racism, sexism and inequality in Brazil, among others. One of the salutary research's final considerations is to highlight that the effectiveness of these laws depends not only on their existence, but also on their proper and consistent application. Furthermore, the fight against racism goes beyond laws. It is fundamental to invest in a continuous work of education and awareness that involves the whole society. The anti-racist culture must be promoted from childhood, through education and example. It is important that children have access to an education that values diversity and teaches about the fight against racism, so that they grow up with a more developed racial awareness and can contribute to building a more just and egalitarian society for all.
