The administrative disciplinary process is the main tool to investigate irregularities and offenses
committed by public servants. This determination is mandatory for the authorities who have
knowledge of administrative violations. For this purpose there are instruments that are part of
the management system correição. These instruments predate the disciplinary process and
serves to subsidize it, or at least serve the judgment of admissibility of the case. To analyze the
effectiveness and importance as well as the legal basis of these preliminary procedures,
considering the current legislation that deals with the subject, case law and the doctrine of
several authors, there was detailed study of each preliminary procedure of the administrative
process, starting from process as a fundamental tool, with analysis of their requirements, phases
and principles to their instruments which it is based. Disciplinary proceedings are historically
linked to public management, because it is a power and duty of the public manager determine
the conduct of its employees. As it presents a high cost to the Administration, if researched on
amounts committed to conducting a disciplinary administrative process in the Administration
and the agency to carry out this research will be the Federal University of Tocantins, UFT. The
performance of disciplinary power allows it to establish a process that burdens both the
Directors and the honor of their servers, when really it is shown not necessary, so the survey
found the results of disciplinary proceedings under the UFT. |
