For the theoretical component of this study, a review of critical criminology and feminist theories elaborated in the socio-legal field was conducted. As for the empirical part, this included both, observations of hearing procedures, as well as semi-structured interviews. The interviews allowed to understand the paths taken by women in situations of domestic violence within the judicial agency, as well as the magistrates perceptions about their own work. The discussion presented is intertwined with the narratives collected in the field, which help to identify the problems involved in the relationship between the criminal justice system and women in situations of violence, a relationship marked by varied forms of institutional violence – revictimization – against these women. The analysis highlight, above all, these women’s narratives and perceptions about the criminal justice system and the way they feel treated within court proceedings. The fieldwork made possible to identify the difficulties related to the inability of protection mechanisms and of legal assistance contained in Law no. 11.340/2006, known as “Maria da Penha” Law, as well as revictimization processes triggered by state agents. The methodological approach is qualitative and interdisciplinary. CAPES - Coordenação de Aperfeiçoamento de Pessoal de Nível Superior A presente pesquisa tem como propósito analisar os limites e as tensões enfrentadas pelas mulheres em situação de violência a terem acesso à justiça nas Varas de Violência Doméstica e Familiar contra a Mulher (VVDFM) do Tribunal de Justiça do Estado do Pará (TJPA), tendo como base pesquisa de campo e referencial teórico referente à criminologia crítica e as teorias feministas elaboradas no campo sócio-jurídico. Para tanto, foi realizada pesquisa empírica a partir de observação de audiências de instrução e entrevistas semiestruturadas com as mulheres em situação de violência e magistrados. As entrevistas objetivaram compreender quais os caminhos trilhados pelas mulheres em situação de violência doméstica no âmbito da agência judicial, bem como a percepção que os magistrados possuem acerca de suas atuações profissionais. A discussão será permeada pelos relatos colhidos em campo, visando identificar quais os problemas envolvidos na relação entre sistema de justiça criminal e mulheres em situação de violência acarretam formas de violência institucional - revitimização -, em face dessas mulheres. A análise privilegia, sobretudo, a dimensão das narrativas das interlocutoras como forma de evidenciar as suas percepções sobre o sistema de justiça criminal e o modo como são percebidas por este sistema. O trabalho de campo permitiu identificar as dificuldades relativas a ineficácia dos mecanismos de proteção e de assistência judiciária constantes da Lei n°. 11.340/2006, conhecida como Lei Maria da Penha (LMP), além de processos de revitimização desencadeados por agentes estatais.
