To accomplish such aim, we will start from the critical confrontation that Foucault establishes with the idea of sovereign power within the called Modern State in Jean Jacques Rousseau. From this focus we intend to indicate, initially, that the Genevan philosopher when wrote the entry Political Economy in the Encyclopedia (1755), aims to present the need for an economic and administrative management about people’s possessions and lives, then registers the Social Contract (1762) as a logical extension of his two essays (1749 and 1755). This way, Rousseau seeks to legitimize the members of the society behavior, for this, the citizen need to delegate his individual and particular power towards a general will. In the course mentioned above, Foucault criticizes precisely this notion of sovereignty, because the Frenchman identifies that there is an intermediate body [government] equipped with a legal apparatus that becomes in practice a camouflaged government management, whose main tools are security devices to regulate the population. This idea of a government as a population government uses techniques of power, that is, technological devices to regulate the members of this state, in developing a controlling method under the guise of a discourse for the welfare of the population. O objetivo geral desse trabalho é mostrar de que forma a concepção jurídica-legal do poder no século XVIII possibilitou a ampla compreensão do termo governamentalidade, pois as estratégias políticas estavam direcionadas ao controle da população tal como exposto no curso “Segurança, Território, População”, ministrado por Michel Foucault no Collège de France, em 1977-1978. Para realizar tal intento, partiremos da confrontação crítica que Foucault estabelece com a ideia do poder soberano no interior do chamado Estado Moderno em Jean-Jacques Rousseau. A partir desse enfoque pretendemos indicar, inicialmente, que o filósofo genebrino ao escrever o verbete “Economia Política” na Enciclopédia (1755) tem a finalidade de apresentar a necessidade de uma gestão econômica e administrativa sobre os bens e a vida das pessoas, em seguida, registra a obra Do Contrato Social (1762) como extensão lógica dos seus dois ensaios (1749 e 1755). Dessa maneira, Rousseau visa legitimar o comportamento dos integrantes da sociedade, e para isso, o cidadão precisa delegar seu poder individual e particular em direção a uma vontade geral. No curso acima referido, Foucault critica, exatamente, essa noção de soberania, pois o francês identifica que há um corpo intermediário [governo] equipado com um aparato jurídico que se torna na prática uma gestão governamental camuflada cujas ferramentas principais são os dispositivos de segurança para regulamentar a população.
