The purpose of the article is to verify how the global and inter-american human rights protection system has understood the state's role in situations of domestic and family violence. A feminist methodology based on the perspective of transformation of the institutions is realized, recognizing limits and also presenting potentialities in the defense and promotion of women's rights. The research is bibliographic and documentary, being analyzed the international and national documents of recognition of the rights of women and decisions of the Inter-American Court of human rights on the subject. No presente artigo analisamos, a partir da atuação dos sistemas internacionais de proteção dos Direitos Humanos, o alcance da responsabilidade do Estado no enfrentamento às violências cometidas contra as mulheres. O objetivo do artigo é verificar de que modo o sistema global e interamericano de proteção de Direitos Humanos tem compreendido a atuação do Estado nas situações de violência doméstica e familiar. Realiza-se uma metodologia de base feminista pautada na perspectiva de transformação das instituições, reconhecendo limites e também apresentando potencialidades na defesa e promoção dos direitos das mulheres. A pesquisa é de base bibliográfica e documental, sendo analisados os documentos internacionais e nacionais de reconhecimento dos direitos das mulheres e decisões da Corte Interamericana de direitos humanos acerca da temática.
