To answer to the question, the case study methodology was adopted to analyze the first stage of PROMABEN. A bibliographic review of legal texts and texts from other sciences was carried out, as well as the collection of empirical data, such as documents and interviews. Data analysis was carried out through the idea of a cycle of public policies and through the dialectical method, comparing institutionalization with practice. The research identified, in the case, a deficient institutionalization of the dialogue. A causality between the deficient institutionalization of dialogue and its ineffectiveness was verified. The necessity to improve dialogue in public policies like the researched phenomenon was found, by breaking with the ideological bases of Brazilian administrative law, originating from the Liberal State. In addition, it is necessary to strengthen the Democratic State of Law, established by the Federal Constitution of 1988, which requires that the public administration adopt a consensual conformation. Finally, proposals are presented for a better institutionalization of dialogue in public policies related to the first phase of PROMABEN. O presente relatório trata de pesquisa que buscou responder como a institucionalização da participação dialógica em atos jurídicos relacionadas à moradia, nas etapas de formulação e execução das políticas públicas, impacta a garantia desse direito fundamental nas cidades da Amazônia? Para responder ao problema, adotou-se a metodologia de estudo de caso para analisar a primeira etapa do PROMABEN. Realizou-se revisão bibliográfica de textos jurídicos e de outras disciplinas, assim como a colheita de dados empíricos, como documentos e entrevistas. A análise dos dados se deu por meio da ideia de ciclo das políticas públicas e por meio do método dialético, comparando-se a institucionalização com a prática. A pesquisa identificou, no caso concreto, uma institucionalização deficiente do diálogo. Foi verificada uma realização de causalidade entre a institucionalização deficiente do diálogo e a sua ineficácia. Identificou-se a necessidade, para melhoria do diálogo em políticas públicas análogas ao fenômeno pesquisado, do rompimento com as bases ideológicas do direito administrativo brasileiro, oriundas do Estado Liberal. A partir disso, deve-se fortalecer o Estado Democrático de Direito, instituído pela Constituição Federal de 1988, o que exige que a administração pública adote uma conformação consensual. Por fim, faz-se a apresentação de propostas para uma melhor institucionalização do diálogo em políticas públicas correlatas à primeira fase do PROMABEN.
