At the centre of the legal debate in Brazil has been the institutionalization of is the challenge for the realization of the principle social function of property. The long-term exploitation of natural resources and the occupation of the rural lands have resulted in immeasurable consequences that have affected the owners, the local communities and the whole of the Brazilian society. Brazil’s Constitution of 1988 laid out the foundation on how the social function of rural property can be fulfilled. The Constitution also extends the same rights to own property and land as were stipulated in Magna Carta. This study describes and analyses the criteria pertaining to the social function of the rural property, which is seen as essential in maintaining and promoting both human and sustainable development through the implementation of public policies. CAPES - Coordenação de Aperfeiçoamento de Pessoal de Nível Superior As questões agrárias carecem de respostas políticas e jurídicas, pois são fruto de cinco séculos de ocupação desordenada do solo brasileiro. No cerne do debate jurídico está o desafio para a efetivação do princípio da função social da propriedade. A utilização desenfreada dos recursos naturais – em desacordo com as normas e legislações de proteção ambiental, e a ocupação indevida das áreas rurais, ocasionam lacunas jurídicas e consequências incalculáveis não apenas a seus proprietários e possuidores, mas à sociedade como um todo. A Constituição Federal de 1988 prevê requisitos indispensáveis e cumulativos ao cumprimento da função social da propriedade rural. Além dessa previsão legal, o texto constitucional disciplina o instituto em diversos dispositivos legais espraiados pela Carga Magna. A presente pesquisa destina seus esforços à abordagem de uma interpretação extensiva dos critérios atinentes à função social da propriedade rural, ao abordá-la como ferramenta ao cumprimento do mínimo existencial ecológico, com intuito de obstar o retrocesso socioambiental.
