It examines how, in recent decades, the demand for the legalization of abortion was established as a right to abortion, especially by the feminist movement in the context of social struggles in Brazil, and how this right was inserted into the speech of Human Rights, from the theoretical formulation and normative construction of sexual and reproductive rights. Contextualizes the denial of women's right to abortion in the context of gender norms and regulations about sexuality. Discusses the possibility of recognition of this right by the Brazilian judiciary, by analyzing processes on abortion in Belém (PA) and judgments of the superior courts relating to claims for judicial authorization for termination of pregnancy in cases of severe fetal anomalies. The examination of the legal practice of abortion in Brazil reveals that the judiciary is a battlefield in which the right to abortion is still in dispute. Tendo como base os princípios fundamentais fornecidos pelos Direitos Humanos – sobretudo, a igualdade, a liberdade e o respeito à dignidade humana – trata-se do direito das mulheres ao aborto. Examina-se como, nas últimas décadas, a demanda pela legalização do aborto foi constituída enquanto direito ao aborto, especialmente pelo movimento feminista, no contexto das lutas sociais no Brasil, e como tal direito foi inserido no campo dos Direitos Humanos, a partir da formulação teórica e a construção normativa dos direitos sexuais e reprodutivos. Contextualizase a negação do direito ao aborto no âmbito das normas de gênero e das intervenções e regulações sobre a sexualidade, e discute-se a possibilidade de que tal direito seja reconhecido pelo Judiciário brasileiro, por meio da análise de processos sobre aborto em Belém (PA) e acórdãos dos tribunais superiores referentes a pedidos de autorização judicial para interrupção da gestação em caso de anomalia fetal grave e incompatível com a vida extra-uterina.
