To this end, it seeks to demonstrate, as theoretical premises, which are the system and principle concepts more consistent with the current stage of development of the science of law. Then, after setting the basic contours of the notion of collective process with which to work, going to study the theoretical and practical aspects of mass litigation phenomenon and, finally, demonstrate the reasons why the collective process is the best way to processing, even not being the path taken by national legislation and jurisprudence. O trabalho, partindo de um panorama geral dos impactos que as intensas mudanças sociais ocorridas nas últimas décadas (e que levaram significativa corrente de sociólogos e filósofos a identificar o surgimento de um novo paradigma, o da pós-modernidade) ocasionaram sobre a realidade jurídica, foca sua análise sobre uma delas, qual seja, o da litigância repetitiva ou massificada, defendendo a utilização do denominado processo coletivo como instrumento mais adequado ao enfrentamento dos desafios surgidos. Para isso, procura demonstrar, como premissas teóricas, quais são as noções de sistema e princípios jurídicos mais consentâneas com o atual estágio de desenvolvimento da ciência do direito. Em seguida, após fixar os contornos básicos da noção de processo coletivo com a qual se trabalhará, passa a estudar os aspectos teóricos e práticos do fenômeno da litigância massificada e, por fim, demonstrar as razões pelas quais o processo coletivo consiste no melhor meio para seu processamento, ainda que não esteja sendo este o caminho trilhado pela legislação e jurisprudência nacionais. 2018-03-14T14:15:56Z 2018-03-14T14:15:56Z 2016-07-21 Dissertação VALENTE, Bruno Araújo Soares.
