In the face of risk society, the grand ventures have gained prominence in the globalized world for large-scale production. However, people became hostages in their own homes. After all, they have no control over their environment. On the other hand, the historically devastated environment is threatened and jeopardized by risk, if not the classic environmental damage and its severity that destroys families, cities and the entire ecosystem of a given region. This does not exclude the possibility of spreading to other places due to its degree of extension and the lack of necessary containment technique. As will be explained, the principle of full redress promotes formal legal justice as being relatively ineffective, as any attempt at redress or compensation is considered symbolic. Given the problem, the research aimed to clarify the possibility of configuring the risk-damage, new classification adopted by Professor Luciana Chiavoloni in her doctoral dissertation. To this end, the historical evolution, the principles of Environmental Law and its constitutional perspective, fundamental concepts, the configuration of intolerable environmental risk will be analyzed. jurisprudential and doctrinal development on the subject. Sob o manto da responsabilidade civil, o presente trabalho visa analisar a possibilidade da configuração do dano ambiental extrapatrimonial coletivo com base no risco ambiental intolerável, em conformidade com a tutela ambiental preventiva. Diante da sociedade de risco, os grandiosos empreendimentos ganharam destaque no mundo globalizado em prol da produção em larga escala. Contudo, as pessoas se tornaram reféns nas suas próprias casas. Afinal, não têm controle sobre o meio que vivem. Por outro lado, o meio ambiente já historicamente devastado é ameaçado e prejudicado pelo risco, quando não o dano ambiental clássico e a sua gravidade que destrói famílias, cidades e todo o ecossistema de uma determinada região. O que não exclui a possibilidade de se alastrar para outros lugares diante do seu grau de extensão e a falta de técnica necessária de contenção. Como será exposto, o princípio da reparação integral promove a justiça jurídica formal por ser relativamente ineficaz, pois qualquer tentativa de reparação ou compensação é considerada simbólica. Diante da problemática, a pesquisa visou esclarecer sobre a possibilidade da configuração do dano-risco, nova classificação adotada pela professora Luciana Chiavoloni em sua tese de doutorado.
