Therefore, the use of standards and requirements in the development of computerized management and preservation systems is indispensable to ensure the reliability of digital documents, including: security, authenticity, preservation, and access. In this sense, digital documents cannot be isolated. They must be within a computerized system and a chain of custody, following an approach that manages it systematically manage them efficient by following models, requirements and regulations, with security since the first stages of the document until its final destination. The objective of this work was to identify the existence of a chain of custody related structures in the Electronic Lawsuit Process system, from the investigation of the normative and legal instruments, since there is a considerable increase of documentary mass in digital media. This research is justified by the difficulties of digital preservation and the inherent characteristics of the digital archive document in the absence of a chain of custody. Regarding the universe of research, the investigation of the electronic judicial process system was delimited in analyze the chain of custody of archival documents and a possible reliable digital archival repository. As a sample, this study uses the use of the Electronic Lawsuit Process in the Regional Labor Court systems of the 8th Region. The methods used for the production of this research are based on a methodological triangulation: literature review, exploratory research, and semi-structured interviews, to present a discussion about what the archival theory exposes in relation to the chain of custody, and the reality from the Electronic Lawsuit Process from the Regional Labor Court systems of the 8th Region. As a result of this research, it was possible to identify gaps related to the requirements made available by MoReq-Jus. Thus, the interviews corroborated an exploratory analysis for the view of the absence of an RDC-Arq, constituting a break in the chain of custody. As final considerations, it is expected that this research will contribute as a source of information to assist in digital preservation strategies about the Electronic Lawsuit Process. Com os avanços das Tecnologias de Informação e a elaboração de novos suportes documentais, surge o documento digital, que traz novos desafios para a gestão e preservação de documentos, em razão de existir uma dissonância entre as práticas arquivísticas em suportes tradicionais e digitais. Portanto, é indispensável a utilização de normas e de requisitos no desenvolvimento de sistemas informatizados de gestão e de preservação, de modo a garantir a confiabilidade dos documentos em formato digital, incluindo: segurança, autenticidade, preservação e acesso. Sendo assim, os documentos digitais não podem estar isolados, eles precisam estar dentro de um sistema informatizado, dentro de uma cadeia de custódia, seguindo uma abordagem que o gerencie sistemicamente seguindo modelos, requisitos e normativos para o gerenciamento eficiente, com segurança desde as primeiras fases do documento até sua destinação final. Como objetivo deste trabalho, buscou-se identificar a existência de estruturas relacionadas a cadeia de custódia no sistema de Processo Judicial Eletrônico, a partir da investigação dos instrumentos normativos e jurídicos, já que existe um aumento considerável de massa documental em meio digital. Desta forma, a pesquisa se justifica pelas dificuldades da preservação digital e as características inerentes ao documento de arquivo digital na ausência de uma cadeia de custódia. Com relação ao universo de pesquisa, delimitou-se a investigação do sistema de Processo Judicial Eletrônico a respeito de cadeia de custódia de documentos arquivísticos e repositório arquivístico digital confiável. Como amostra, este estudo utiliza o uso do Processo Judicial Eletrônico nos sistemas do Tribunal Regional do Trabalho da 8ª Região. Os métodos usados para a produção desta pesquisa se baseiam em uma triangulação metodológica sendo: revisão de literatura, pesquisa exploratória e entrevistas semiestruturadas, para apresentar uma discussão acerca do que a teoria arquivística expõe com relação cadeia de custódia, e a realidade constada no sistema de Processo Judicial Eletrônico da Justiça do Trabalho da 8ª região. Como resultados desta pesquisa, foi possível identificar lacunas com relação aos requisitos disponibilizados pelo MoReq-Jus, além disso as entrevistas corroboraram com análise exploratória para a visão da inexistência de um RDC-Arq se configurando portanto, em uma quebra da cadeia de custódia.
