For that, it is necessary to evaluate the evolution of the LGBT movement and its conquests of rights in Brazil, to elucidate the importance of the Yogyakarta Principles for the LGBT movement, as well as the process that preceded it in international protection systems and to identify how this letter of principles has been used by the Federal Supreme Court. An inductive method research is then carried out, so that, through jurisprudential research, it is possible to infer this universal truth. Given this, it appears that the LGBT movement has struggled for decades for recognition as citizens of law; the Yogyakarta Principles are an important part in the process that triggered deliberations on sexual orientation and gender identity at the international level; the STF uses this letter of principles as a basis in its decisions, giving it an important legal value, which imposes the realization that the Yogyakarta Principles can be recognized as general international law custom on the national scene. Tendo em vista que o Brasil é um país onde os membros da comunidade LGBT conquistam a maioria de seus direitos através do Poder Judiciário e suas construções jurisprudenciais, pesquisa-se sobre os princípios de Yogyakarta e a sua receptividade nas fundamentações do Supremo Tribunal Federal, a fim de identificar como as essas princípios influem as decisões da Corte brasileira. Para tanto, é necessário avaliar a evolução do movimento LGBT e as suas conquistas de direitos no Brasil, elucidar a importância dos Princípios de Yogyakarta para o movimento LGBT, bem como o processo que lhe antecedeu nos sistemas de proteção internacionais e identificar como essa carta de princípios tem sido utilizada pelo Supremo Tribunal Federal. Realiza-se, então, uma pesquisa de método indutivo, para que, através da pesquisa jurisprudencial, seja possível inferir essa verdade universal. Diante disso, verifica-se que o movimento LGBT luta há décadas pelo reconhecimento enquanto cidadãos de direito; os Princípios de Yogyakarta são parte importante no processo que desencadeou as deliberações sobre orientação sexual e identidade de gênero em âmbito internacional e; o STF se utiliza dessa carta de princípios como fundamento em suas decisões, conferindo a ela importante valor jurídico, o que impõe a constatação de que os Princípios de Yogyakarta podem ser reconhecidos enquanto costume internacional no cenário nacional. 2022-11-21T17:47:27Z 2022-11-21T17:47:27Z 2020-08-24 Trabalho de Conclusão de Curso - Graduação NASCIMENTO, Éden Sousa.
