For that matter, the evolutionary history of AIDS in Brazil and in the world was approached as a way of understanding the creation of safety measures which have made a certain group of people with sexual risky behavior unfit for blood transfusion, intending to prevent contamination of receivers. In this work, several bibliographies and normatives were also analyzed, so that the research demonstrated that despite the past of world history that has condemned, for a long time, the gay community to be stigmatized for having risky sex, this stigma must be surpassed, given that this community has been undergone several rights restrictions throughout history which have demonstrated that the fundamental rights of the LGBTQIA + community must be guaranteed not only through the CFRB / 1988 but also by means of international treaties signed by Brazil. From the analyzed normatives it was noticed the contrariety in the requirements to make this blood donor unfit for donation; therefore it was realized that the normatives are prejudiced and unconstitutional texts, which try to perpetuate the stigmas suffered by gay men in a way that violate the right to equality and non-discrimination of gay men. Este trabalho tem como objetivo analisar a evolução de direitos da comunidade LGBTQIA+, os estigmas sociais sofridos pelo homem gay e a homofobia normativa contida na inaptidão temporária na doação de sangue por homens gays presente nas normativas RDC n. 34/2014 da ANVISA e Portaria nº 158/2016 do Ministério da saúde. Nesse sentido, foi abordado o histórico evolutivo da AIDS no Brasil e no mundo, como forma de entender a criação das medidas de segurança que tornavam inapto certo grupo de pessoas com comportamento sexual de risco como forma de prevenir a contaminação dos receptores da transfusão de sangue. Neste trabalho também foram analisadas diversas bibliografias e normativas, de modo que a pesquisa demonstrou que apesar do passado da historia mundial ter condenado, por muito tempo, a comunidade gay a ser estigmatizada por possuir sexo de risco, esse estigma deve ser superado, haja vista que esta comunidade já passou por diversos cerceamentos de direitos no decorrer da história que demonstraram que os direitos fundamentais da comunidade LGBTQIA+ devem ser assegurados não somente pela CFRB/1988 como também por tratados internacionais assinados pelo Brasil. Das normativas analisadas foi percebida a contrariedade contida nos requisitos para tornar esse doador de sangue inapto para doação, de forma que percebeu-se que as normativas tratam-se de textos preconceituosos e inconstitucionais, que tentam perpetuar os estigmas sofridos por homens gays, de modo que atentam contra o direito à igualdade e à não discriminação de homens gays. 2022-11-21T18:37:35Z 2022-11-21T18:37:35Z 2020-08-21 Trabalho de Conclusão de Curso - Graduação CUNHA, Raí Leorne Castro.
