This article analyzes to what extent the concession of special use for housing purposes
(CUEM), a legal instrument provided for in the City Statute (Federal Ac nº 10.257/2001),
promotes the Right to Housing. The analysis focuses on the Municipality of Belém do Pará, in
the context of the Chão Legal Program created by the municipal management in 2010 and
replaced by the Terra da Gente Program in 2021. The analysis was carried out through
bibliographical research, documentary research in which they were analyzed laws and
normative acts about the object of the article and interview carried out on June 6, 2023 with a
social worker in charge of the Land Regularization Coordination of CODEM. The text first
addresses the social function of property and the Right to (Adequate) Housing at national and
international level, citing international documents that provide for this human right. Then, it
deals with the general guidelines of urban policy at the national and municipal levels. Then, it
discusses the instrument of granting special use for housing purposes in national and
municipal legislation, passing through the Master Plan of Belém and the Chão Legal Program.
Finally, it analyzes whether the referred program promoted the Right to Adequate Housing.
