Analyzing its obligatoriness in all levels of education, as well as, stating how the teaching of History, more precisely the environmental history, is made of paramount importance for the realization of this right. Since the environmental debate brought by history helps to initiate the process of building a sustainable awareness in the student, and the perception of this as one of the main agents in the historical process. O presente artigo tem por objetivo, trazer uma análise sobre as dificuldades de inserção da educação ambiental no âmbito escolar, prevista sobre a égide da legislação que trata sobre este tema, com ênfase na educação formal e no ensino de História. Analisando sua obrigatoriedade em todos os níveis de ensino, bem como, constatando como o ensino de História, mais precisamente a história ambiental, se faz de suma importância para a efetivação deste direito.
