The guarantee of the right to health, recognized by the national constitution, is an issue with repercussions throughout the world, especially in Brazil where the state does not provide access to a public health system with dignity for its citizens, despite the predicted provision of universality in the planning and regulation of the National Health System (Sistema Único de Saúde). A dichotomy is created between the norm and the reality experienced by the people in need of the public health system. At the core of the study is the analysis of the right to health as a fundamental social right not being carried out satisfactorily by the state, thus culminating in the implementation of the Health Law. This paper focusses on the discussion and examination of ways to improve access to health, in relation to the implementation of the Health Law. Thus, what this paper seeks is not to present a miraculous solution for the shortcomings of public health, but a better alternative of judiciary power to address the problems created by the inefficiency of public health, and consequently the implementation of the Health Law, through the transformation of one of the courts of Public Office into a specialized court to deal with fundamental rights, especially the right to health, providing citizens with an adequate and dignified judiciary service. Este trabalho analisa o fenômeno da judicialização do Direito da Saúde como forma da materialização do direito fundamental à saúde. A garantia do direito à Saúde, reconhecido pela ordem constitucional pátria, é tema de repercussão no mundo inteiro, especialmente no Brasil, onde o Estado não fornece com dignidade aos cidadãos o acesso à Saúde Pública, em que pese à previsão de universalidade prevista no ordenamento que regulamente o Sistema Único de Saúde. Cria-se uma dicotomia entre a norma e a realidade vivenciada pelas pessoas que necessitam da Saúde Pública. Como cerne do estudo partiu-se da análise do Direito à Saúde como Direito Fundamental Social não realizado de forma satisfatória por parte do Estado culminando na Judicialização do Direito de Saúde. Debater e analisar formas de melhorar o acesso ao direito à saúde, relacionado com a judicialização da Saúde é foco principal no presente trabalho. Assim, o que se busca não é apresentar uma forma milagrosa para a solução das deficiências da Saúde Pública, mas sim uma alternativa de melhor adequação do Poder Judiciário para enfrentar a problemática criada pela ineficiência da Saúde Pública, e por consequência da judicialização da Saúde, através da transformação de uma das Varas da Fazenda Pública em Vara Especializada no trato das ações que envolvam direitos fundamentais, especialmente, o direito da saúde, propiciando ao cidadão uma prestação jurisdicional adequada e digna. 2016-03-17T19:59:41Z 2016-03-17T19:59:41Z 2015-12-09 Dissertação CANEDO, Alessandro de Paula.
