Food Security Guarantee CNPQ::CIENCIAS SOCIAIS APLICADAS::DIREITO The main purpose of this paper was to identify the various aspects of the civil prisoner of the maintenance debtor, mainly showing how this coercion is used and its dubious effectiveness when applied in certain circumstances. The study of the civil prison for food debts is, in fact, an important and controversial subject and should always analyze human rights, both in the aspect of the fed creditor, who needs means for their subsistence, and in the aspect of the defaulting can‘t simply be coerced into payment without due respect to his dignity. The research problem was what would be the scope of the civil prison for failure to provide food and what the real reach of this type of prison. The main objective of this research was to analyze the effectiveness of the prison as a coercive means in the execution process. To reach the desideratum was used quantitative qualitative methodology that had two types of research: bibliographical, analysis of jurisprudence, examination of Brazilian legislation and documentary. At the end of the present research, it is concluded that, inspired by Portuguese legislation and guaranteeing the effectiveness of the food budget for children and / or adolescents, we have proposed an alternative method of solving this problem, with the creation of a Food Guarantee Fund for Minors, which, in partnership between the Court of Justice and the Government of the State of Tocantins, should be observed which is the most appropriate and which will lead, on a case-by-case basis, to the fulfillment of the obligation more quickly and effectively, taking into account the best interests of the child and the capacity of payment for the food, using the prison as an exception measure, used in the last case only in the hypotheses of the non-payment of the dishonesty and the irresponsibility of the debtor. O presente trabalho teve por escopo fundamental apontar os diversos aspectos da prisão civil do devedor de alimentos, revelando, principalmente, a forma como essa coerção é utilizada e a sua duvidosa eficácia quando aplicada em determinadas circunstâncias. O estudo da prisão civil por dívida alimentar é, de fato, tema importante e polêmico e deverá sempre analisar os direitos humanos, tanto sob o aspecto do credor alimentado, que necessita de meios para sua subsistência, como sob o aspecto do alimentante inadimplente, que não pode ser simplesmente coagido ao pagamento sem o devido respeito à sua dignidade. O problema da pesquisa foi qual seria o escopo da prisão civil por inadimplemento da prestação alimentar e qual o real alcance deste tipo de prisão. Diante disso a pesquisa teve como objetivo central analisar a efetividade da prisão enquanto meio coercitivo no processo de execução. Para alcançar o desiderato foi utilizada a metodologia quali quantitativa que contou com dois tipos de pesquisa: bibliográfica, análise de jurisprudências, exame da legislação brasileira e documental. Ao final da presente pesquisa conclui-se que inspirado na legislação portuguesa e garantir a efetividade da verba alimentar a criança e/ou adolescente, propusemos um método alternativo de resolução desta desídia, com a criação de um Fundo de Garantia de Alimentos a Menores, do qual em parceria entre Tribunal de Justiça e Governo do Estado do Tocantins, deverá ser observado qual o meio mais adequado e que levará, caso a caso, ao cumprimento da obrigação de maneira mais rápida e eficaz, atendendo ao melhor interesse do menor e à capacidade de pagamento pelo alimentante, utilizando-se a prisão como medida de exceção, utilizada em último caso somente nas hipóteses do não pagamento da desídia e pela irresponsabilidade do devedor. 2019-08-06T18:45:47Z 2019-08-06T18:45:47Z 2019-05-31 Dissertação SILVA, Mariana Saraiva Rezende da.
