This thesis talks about Restorative Justice, its origins, the conceptual debate between the theorists and their position in the face of Retributive Justice as an alternative form of dispute resolution, where are considered the needs of the victim and the restoration of relations broken by crime. Our study discusses the implementation of Restorative Justice, particularly in fighting violence in the Brazilian school environment, resorting to different pioneering restorative practices in the country. To address violence in schools it is presented statistical data and questions the current way of routing problem by proposing the implementation of Restorative Justice in the schools, with community participation in resolving conflicts. Under the critical-dialectical approach and referencing the studies of Howard Zehr, it promotes the collection of data on school violence in Araguaína County, Tocantins, with analysis of 136 cases involving infractions reported in 2013, seeking out in which of the crimes cases were practiced within Basic Education institutions. The research reveals the absence of projects guided by Restorative Justice in basic education of Tocantins public schools against, school violence. The research allows us to infer that it is timely for the immediate application of restorative justice in schools, so that there isn’t an escalation of violence, which can result in more serious infractions. In addition, the survey estimates that restorative practices can facilitate the development of peace culture, which assists in the promotion of breaking the vicious circle of school violence. O objetivo de nossa investigação é refletir sobre o uso da justiça restaurativa como instrumento de pacificação social autocompositivo e, meio adequado de concretização dos direitos fundamentais da criança e do adolescente no âmbito escolar da Comarca de Araguaína do Estado do Tocantins. A presente dissertação explana sobre a Justiça Restaurativa, suas origens, o debate conceitual travado pelos teóricos e sua posição diante da Justiça Retributiva, como forma alternativa de solução de conflitos, onde são consideradas as necessidades da vítima e a restauração das relações rompidas pela infração. O nosso estudo discorre sobre a implantação da Justiça Restaurativa, em especial, no enfrentamento da violência no ambiente escolar brasileiro, recorrendo às diferentes práticas restaurativas pioneiras no país. Ao abordar a violência nas escolas apresenta dados estatísticos e questiona a atual forma de encaminhamento do problema, propondo a implantação da justiça restaurativa nas escolas, com a participação da comunidade na resolução dos conflitos. Sob o enfoque crítico-dialético e referenciando-se nos estudos de Howard Zehr promoveu-se a coleta dos dados sobre a violência escolar na Comarca de Araguaína, Tocantins, com análise dos 136 processos relativos a atos infracionais noticiados no ano de 2013, buscando-se em quais casos os delitos foram praticados no interior de instituições de ensino na Educação Básica. A pesquisa revela a inexistência de projetos orientados pela Justiça Restaurativa na educação básica da rede pública tocantinense para o enfretamento da violência escolar. A investigação permite inferir que é oportuna a imediata aplicação da Justiça Restaurativa no âmbito escolar, para que não haja uma escalada da violência, o que pode resultar em atos infracionais mais graves.
