Taking as a basis the holding of the Olympic Games and Paralympic Games in 2016 and the FIFA World Cup 2014 in Brazil, the Differentiated Regime of Contracting (DCR), created by Law No. 12.462/2011, laid down new rules for public procurement and administrative contracts, with the aim of bringing greater speed and at a low cost to the Public sector in its procurement. From this point on, this dissertation studies the forms of the bidding process, its guiding principles, questions raised about the constitutionality of the RDC, and the possibility of increased environmental impact from its use, and analyzes the main innovations in the legal and its impact on the procurement processes carried out by the National Department of Transport Infrastructure (NDTI) in between the years of 2012 and 2014. And concluded that it is necessary for the broad discussion of innovations in the entities and the efficiency of the enforcement system, by integrated hiring, as well as by the uncertainty caused by the use of the secret budget. |
