The Electoral Justice framework is established in the Federal Constitution, as well as
the Lei de Acesso à Informação1
(LAI). In this way, the work now under examination
questions whether the Portal da Transparência2
(PT) of Tocantins' Electoral Justice
fulfills the objectives for which it was created, whether the information provided meets
what the citizen is actually looking for and whether the content of the information
searched by the user is easily understood. It is identified and discussed the adequacy
of PT of the Electoral Justice of Tocantins to the requirements of the Conselho
Nacional de Justiça3
(CNJ), regarding the fulfillment of the requirements of LAI. The
justification for this research was to stimulate the search for clear and objective
information through the PT of the Tocantins' Electoral Justice, as well as the reflection
for an effective exercise of citizenship, allowing the citizen to monitor the functionality
of this portal in an effective and transparent manner. The study analyzes LAI and
assesses its adherence especially regarding the PT of Tocantins Electoral Justice. As
a support tool, the annual questionnaire prepared by the CNJ was used. It was with
this objective in perspective that the CNJ created the ranking da Transparência do
Poder Judiciário4
, which aims to achieve, with objective data, to assess the degree of
information that courts and councils provide citizens. In the 2nd edition, 2019, the items
under evaluation were divided into categories within two groups: Active Transparency
(TA) and Passive Transparency (TP). The survey assessed the level of Active and
Passive Transparency. The work was divided into stages: theoretical and practical
recognition (case study) of the object of study; analysis of the questionnaire or
Evaluation and Scoring Table (TAP) of the information made available on the internet
by the CNJ, comparative analysis of PT in relation to the Lei de Acesso à Informação
(LAI); construction of a technical proposal to support PT, containing as appendices
suggestions for improvements to the public portals managers. The work used
bibliographical and documentary research. Data collection was based on the results of
the questionnaire applied by the CNJ. The choice for the Content Analysis method was
due to the very interpretative nature of this work. The research carried out followed a
qualitative approach. The emphasis was on observing and analyzing the
implementation stage of the Active and Passive Transparency categories within the
scope of Electoral Justice, based on LAI. Considering its the purposes, the research
had an exploratory and descriptive character. In this perspective, it is possible to
assess the adequacy of PT of the Electoral Justice of Tocantins to the requirements of
the CNJ, regarding the fulfillment of the requirements of LAI, especially considering the
significant evolution of the Electoral Justice in the transparency ranking, making
information available in an agile and fast way to public service user. In the 2019 edition
of the transparency ranking, the information made available on the TRE-TO PT was
checked by the CNJ and obtained an assessment of 90.16%. This demonstrates that
the visibility policy implemented by TRE-TO has been shown to be effective and
efficient. |
