Assisted “freedom” is one of the socio-educational measures provided for in the Child and Adolescent Statute. It stands out for its particularity, since it provides the subject to fulfill a penalty enjoying his "freedom", while being "resocialized" in his family and community, however, this measure has not received due importance. In this sense, it was proposed in this analysis, to understand the historical course of assisted “freedom”, the transformations that occurred in its scope, and how they are being executed today by professional apprehensions, being necessary to examine the doctrine of protection and other legislation that complement it. Therefore, understanding the sense of freedom was essential so we analyzed the understandings of freedom, in the understandings of Aristotle, Kant, Hegel and Marx, and we orient our analyzes and understandings based on the studies of Marx, because we share his judgment, that freedom is anchored in the possibility of choices between real alternatives, in which the subject free from impositions and coercions has the possibility to perform his actions in the material world from his own choices, which is not possible in society. capitalist, which allows the subject only an abstract freedom. From then on, we unveiled the historical path of assisted “freedom” until the current statute, understanding that there was no total overcoming of LA with the old forms of execution. This reality corroborates our understandings about the professional paradigm faced today, which causes the disqualification of the measure. The analyzes presented show that professional work, which configures the interdisciplinarity of care in assisted "freedom", is permeated by professional practices aimed at surveillance, control, enforcement and coercion and not by the socio-education carried out by socioeducational professionals. We find that the measure is secondary to the structure of assistance policy, which may characterize assisted “freedom” as “unassisted”.
