This work aimed to discuss the Continuous Cash Benefit (BPC) for the Elderly: a limited social right, however, necessary. The object of study consisted of the applicability of the BPC concession criteria, thus bringing as a problem, how these criteria established for the concession of the BPC are applied to elderly people from Miracema, seeking to know and analyze how the process of accessing the Benefit Benefit works. Continued for the elderly in the city of Miracema do Tocantins in 2019, with the following specific objectives: to identify the criteria for accessing the BPC for the elderly population and how these established criteria can hinder access to the BPC. It is supported by a critical dialectical theoretical framework, so that one could actually understand the posed reality. The research was characterized as bibliographical and documentary, through information from official internet sites and authors who deal with the theme, in addition to legislation that guarantee the rights of the elderly, also meaning a research of an explanatory nature. The study presents the struggle of the Elderly for social rights, the participation of Social Service, the Social Assistance Policy in Brazil with the Federal Constitution of 1988, in addition to the BPC/Elderly person (a), its evolution as legislation and also its obstacles, emphasizing mainly the two criteria that hinder access to the benefit, such as being 65 years of age or older and per capita income less than a quarter of the minimum wage, thus, it is important to better understand the realization of these rights, since there is still a welfare culture in Brazil, in which the citizen is guaranteed the right, but there are also many obstacles for them to be really enjoyed. The result confirmed a reduced number of elderly people assisted by the BPC in the city of Miracema do Tocantins in 2019, which makes us conclude that although the benefit is legally provided for as a right for this public, it constitutes a highly excluding protection through criteria, sparsely and insufficiently for the elderly population, and consequently not being effective as it should be, the subjects being dependent on this type of system that is placed in society.
