Resumo:
The popular initiative is for democracy as one of the most important instruments for its viability, because it allows the participation of the social actors of a determined territory in the legislative process, which is an instrument of popular sovereignty, foreseen in the Federal Constitution of 1988, for through it the population can present bills to the legislatures: federal, state, and municipal. The present research therefore sought to deepen a study published in 2018 by the Institute of Technologies & Society of Rio-ITS, entitled: Report: Draft laws of popular initiative in Brazil that makes a detailed investigation of how the Popular Initiative behaved as a device since the promulgation of the Magna Carta. The study that was proposed raised the figuration of this one in the capitals, from its reception in the respective instruments: Organic Laws and Internal Regulations, until the presentation statistics of projects with this characteristic, the results provided a portrait of how the referred device presents itself in a different way. practical and direct way to municipal legislative houses. Of an inventory bibliographic nature, the study methodologically was guided by conducting the methodological survey, initially by investigating the information with the City Councils of the capitals, and in addition to the available bibliography. The result of the study pointed to a sum of insufficiency of the Popular Initiative as a legal device capable of initiating the legislative process in the City Councils of Brazilian capitals.
