This article aimed to analyze the constitutionality of changes in legislation promoted by the
Labor Reform in the work of pregnant and breastfeeding women in unhealthy environments,
and to relate the possible diseases caused by these environments. For this, an exploratory and
qualitative research was carried out, researching the bibliography and jurisprudence on the
subject, seeking insights and understandings about the general nature of the objectives of this
work. It was found that the change in the art. 394A of the Consolidation of Labor Laws is
unconstitutional, as it violates several articles of the Federal Constitution, in addition to the
principle of prohibition of social retrogression. Several diseases and disorders related to the
work of pregnant and breastfeeding women in unhealthy environments were also found,
demonstrating that the work of these women in these environments is not recommended. |
