The new coronavirus pandemic has impacted the lives of billions of people. Measures of
social distancing and quarantine were imposed by the State, which resulted in enormous
damage to the business people . The Federal, State and Municipal governments create d
measures to help the business people , focused mainly on micro and small entrepreneurs,
however, thousands of companies bankrupted , unemployment increased and the fragile
Brazilian economy retracted. The present study puts in perspective the institute of
disregard of the legal personality, more specifically its reverse modality. As for the
methodology used in the study , the deductive method was observed, which starts from
common premises to reach a logical conclusion. By the study’s end the conclusion is t hat
the unrestrained application of this institute, resulting from the adoption of the Minor
Theory by the Labor Court, makes it difficult to exercise commercial activity and
discourages the emergence of new entrepreneurs, in a socioeconomic context advers e to
employers.
