This study is about the regression of the fulfillment of the sentence in semi-open regime in the region of Porto Nacional. The penalty of deprivation of liberty is an acrimonious but necessary imposition. Its abolition is not sought, but to reflect on the fulfillment of the basic functions of retribution and social reintegration of the distressed. What society intends to do that by committing a criminal conduct breaks the social pact, attracting public revenge for itself, whereas it is only the State that has to punish, and private revenge intolerable? It is true that the prison system is based on the promise of reintegrating the prisoner into society. The present dissertation devotes its last two chapters to demonstrate the falsity of this promise and to point out viable suggestions to mitigate the deleterious effects of the omission of the State. In the first chapter there is a historical approach of the penalty from the primitive age to the contemporary age, emphasizing the criminal history of Brazil and Porto Nacional. In the second chapter, the profile of the re-educators who serve their sentence in the semi-open regime in the Porto National Public Prison is analyzed, comparing with the survey done by the Ministry of Justice at national and state level. In the last chapters, a study and reflection on the bankruptcy of the social reintegration of the prisoners is carried out, as demonstrated by the high rate of penitentiary recidivism and fugues as the main cause of the regression of the semi-open regime.
