With this information, the present work aims to investigate, through the deductive method, how the process of demarcation of indigenous lands can effect the right to demarcated land and whether the demarcation of indigenous lands is efficient to protect the right to territoriality. In view of the information collected throughout the research, it is concluded that there has been little progress in the process of guaranteeing the fundamental right to the demarcated land, despite the Brazilian legal system, especially the Federal Constitution of 1988, contributing to affirm this right, which is extremely important to preserve the life and cultural identity of native and generational peoples to preserve the environment, many obstacles need to be removed to realize this fundamental right, including a persistent omission of public authorities in law enforcement. Analisar a história jurídica do Brasil passa necessariamente pelo processo de violência contra as comunidades indígenas, bem como a ocupação e colonização de suas terras. Considerando essas informações, o presente trabalho tem por objetivo investigar, através do método dedutivo, como o processo de demarcação de terras indígenas pode efetivar o direito a terra demarcada e se a demarcação de terras indígenas é eficiente para resguardar o direito à territorialidade. Diante das informações coletadas ao longo da pesquisa, conclui-se que, poucos foram os avanços no processo de garantia do direito fundamental à terra demarcada, apesar de o ordenamento jurídico brasileiro, principalmente a Constituição Federal de 1988, contribuir para afirmar esse direito, que é de extrema importância para preservação da vida e identidade cultural dos povos originários e de grande relevância para preservação do meio ambiente, muitos entraves precisam ser removidos para efetivar esse direito fundamental, incluindo a persistente omissão do poder público na aplicação da lei. 2022-01-18T01:20:05Z 2022-01-18T01:20:05Z 2021 Artigo SANTOS, Cícero Ivanildo dos .
