Resumo:
The present work aims to show how the Brazilian Prison System is in a state of decay, where the detainees are treated as human trash, left to fend for themselves, forgotten by the Public Power, disrupting the resocializers ends of the sentence. As a result of the state’s inertia, prisoners organize themselves to form the feared criminal organizations and spread terror within and outside the prison, proving that the state, by itself, does not meet the essential conditions to administer the Brazilian Penitentiary System, requiring to either resort to private partners or through outsourcing or public-private partnerships. The hybrid management system, in the countries which it was implemented, has obtained good results. In Brazil, some states of the federation are adopting and achieving satisfactory results. However for this shared management system to be introduced in Brazil, it is necessary to break some legal, ethical and political obstacles. In order to change this chaotic picture of the Brazilian Prison System, it is necessary to implement the co-management in Brazil so that the penalty fulfills its social function of reprobation and crime prevention
