This discussion is necessary so that deaf education in Brazil is not, as it was for many years, the object of postponement. The objective was to point out some of the challenges that must be faced in view of the new legal guidelines. The research was of a qualitative nature, of the bibliographic type. The main result observed from the literary review, is that even considering the whole legal framework that In the case of deaf education from a bilingual perspective, it will only be effectively realized if the perception of the deaf subject ceases to be deficient, abnormal, and from the anthropological point of view, ie, the cultural subject and multifaceted identities. O presente trabalho está focado num estudo acerca das atuais políticas públicas que orientam a Educação de Surdos no Brasil, previstas na Lei nº 10.436/2002, Decreto nº 5.626/2005 e Plano Nacional da Educação (2014-2024) e os seus principais desafios. Essa discussão faz-se necessária para que a educação de surdos no Brasil não seja, como foi por muitos anos, objeto de postergação. Objetivou-se apontar alguns dos desafios que deverão ser enfrentados, tendo em vista as novas orientações legais. A pesquisa foi de natureza qualitativa, do tipo bibliográfica. O principal resultado observado a partir da revisão literária, é que mesmo considerando todo o arcabouço legal que versa sobre a educação de surdos na perspectiva bilíngue, há muita morosidade na sua operacionalização e pouca efetividade na vida educacional do surdo, sobretudo por parte do governo federal.
