Rhetoric and its persuasive techniques serve as tools for the best and most effective convincing of the speaker, when the speaker faces the arduous task of convincing, from one person to an audience, to a judge in the role of judge, or a jury. composed of seven individuals, in the case of the Brazilian judicial system in the criminal sphere in cases of crimes against life, the latter must have in his persuasive framework methodical techniques of presenting his arguments as effectively as possible. Catalyzing, therefore, the conviction of who is interested an opinion or decision. From the dawn of justice, the written or spoken word has been used to persuade, and the methodology of this work revolves around demonstrating this through bibliographies and documents. In general, we argue that the rhetorical technique provides the speaker with a framework of persuasive methodology, belonging to the legal and discursive domain, based on his knowledge, philosophical, social, empirical, likelihood and emotional of his listener / audience.
