In light of this problem, to address the mineral potential of the state in the country's economic growth, highlighting the incoherence of such wealth does not contribute to the development of the region, is at least "curious" when Article 20, IX, CF / 88, serves as an instrument of collaboration of regional growth, financially compensating the mineral exploitation suffered, since it can be used in the elaboration of public policies in favor of social development. Given this possibility, this study proposes to analyze the factors observed during the period of legalization of the mineral activity, which led to the analysis of the process of regularization of the Mixed Cooperative of Creporizão Development - COMIDEC of the Creporizão Garimpo and of the guiding legal precepts. obstacles to the effective collection of the CFEM in the municipality of Itaituba - Pa, finding that after measures adopted, such as the greater dissemination of the mechanism, the increase in tax collection and the closer relationship between the federative entities, the scenario and the considerable increase in the collection can be observed, realizing that the measures taken by the cooperative to change the scenario, can serve as a parameter to other municipalities, so that the reality of the HDI of the region of Para. At this juncture, an approach was taken to Pará's collaboration in the country's historical economic context and the mining potential still conferred on the state, as well as the precarious condition that afflicts public policies, and how the CFEM can collaborate to change the situation , concluding that the lack of effective compliance with the constitutional norm and the infraconstitutional rules make it propitious for the practice of collecting smaller values than in fact should be and perpetuate the weakness of the condition of life that lives in the society of Pará. Universidade Federal do Oeste do Pará O estado do Pará, detentor de incalculável riqueza mineral, apesar de ter importante papel no desenvolvimento econômico nacional, ocupa uma das piores posições no que tange ao desenvolvimento regional. À luz desse problema, abordar o potencial mineral do Estado no tocante ao crescimento econômico do país, destacando a incoerência de tanta riqueza não contribuir para o desenvolvimento da região, é no mínimo “curioso”, quando o artigo 20,IX, § 1º da CF/88, serve como instrumento de colaboração do crescimento regional compensando financeiramente a exploração mineral sofrida, uma vez que arrecadada pode ser usada na elaboração de políticas públicas em favor do desenvolvimento social. Diante dessa possibilidade, este estudo, através da análise documental do processo de regularização da Cooperativa Mista de Desenvolvimento do Creporizão - COMIDEC do Garimpo do Creporizão e dos preceitos legais norteadores, propõe analisar os fatores observados durante o período de legalização da atividade mineral, que geravam empecilhos a efetiva arrecadação da CFEM no município de Itaituba – Pa, averiguando-se que após medidas adotadas, tais como a maior divulgação do dispositivo, o aumento da fiscalização na arrecadação e o estreitamento na relação entre os entes federativos, o cenário no que diz respeito ao recolhimento foi modificado, e o aumento considerável na arrecadação pode ser observado, percebendo-se que as medidas adotadas pelos cooperados para a mudança do cenário, podem servir como parâmetro a outros municípios, para que se alcance a mudança da realidade do IDH da região paraense. Nessa conjuntura, foi feita uma abordagem da colaboração do Pará no contexto histórico econômico do país e o potencial minerário ainda conferido ao estado, bem como a condição precária que assola as políticas públicas, e como a CFEM pode colaborar para que a situação mude, concluindo que o descaso no cumprimento efetivo da norma constitucional e das regras infraconstitucionais tornam propícia a prática da arrecadação de valores menores do que de fato deveria ser e perpetuam a debilidade da condição de vida da sociedade paraense. 2021-02-26T15:48:39Z 2021-02-26T15:48:39Z 2019-02-05 Dissertation TANAKA, Solange Siqueira da Penha.
