This concept helps to understand the experiences undertaken by peasant households during the occupation, creation and implementation processes of the Virola Jatobá Sustainable Development Project in the municipality of Anapu, State of Pará, Brazil. During these processes, family units built and added, on the basis of their “living law”, different notions of land rights emanated from their social practices, which are often opposed from those of the formal law. In the process of occupation, the research highlights the social and legal practices of the leaders of social local organizations and the families of the first occupants of the area. By registering these practices, it is possible to abstract the notion of rights to of land for those who work on it. In the process of the formal establishment of the settlement, families began to take command of the PDS, through the constitution of an Association, which could negotiate claims on their behalf with the governmental institutions, particularly INCRA, and thus set up the notion of rights to land for those who work on it with relative authonomy. In the process of implementation of the PDS, families faced the execution of the community-based forest management project, which involved a process of negotiation between the government and families regarding the adoption of new working conditions. In this negotiation, the families built the notion of land rights for those who work on it with authonomy taking care of the forest. CNPq - Conselho Nacional de Desenvolvimento Científico e Tecnológico Essa dissertação tem como objetivo analisar e descrever os diferentes aspectos da noção de “direito vivo” apreendida junto às unidades familiares camponesas ao longo dos processos de ocupação, criação e implementação do Projeto de Desenvolvimento Sustentável Virola Jatobá no município de Anapu, Estado do Pará. Nesses diferentes processos, as unidades familiares construíram e acrescentaram, com base em seu direito vivido, diferentes aspectos à noção de direito à terra, a partir de suas práticas sociais e jurídicas que se contrapõem, por vezes, ao que dita o direito formal. No processo de ocupação, se destacam as práticas sociais e jurídicas de lideranças de organizações sociais locais e das primeiras famílias ocupantes da área, e abstrai-se então a noção de direito a terra para quem nela trabalha. No processo de criação oficial do assentamento, as unidades familiares ocupantes passam a assumir o comando do PDS. Para tanto, se fazem representar pela figura de uma Associação para protagonizar negociações e reivindicações perante as instituições do poder público, particularmente o INCRA, e assim se configura a noção do direito a terra para quem nela trabalha com autonomia. No processo de implementação do PDS, as famílias enfrentam a execução do projeto de manejo florestal comunitário, que passa por um processo de negociação entre o poder público e as famílias envolvendo a adoção de novas condições de trabalho. Nessa negociação, se configura a noção do direito a terra para quem nela trabalha com autonomia e cuidado com a mata.
