This fact also generates the possibility of other conducts arising from the absence of this consensus with consequences, including criminal ones. This research aimed to verify the possibility of applicability of Restorative Justice in conflicts of Family Law whether judicial or not, observing its specificities so that the methodological approach could be applied satisfactorily. As a methodology, qualitative empirical research with a hermeneutic focus was chosen. In the phase of restorative justice interventions in concrete cases, the peacebuilding circle method was applied, according to the methodology described by Pranis (2011). First, a bibliographic documentary survey was carried out on restorative justice, family conflicts, restorative practices, projects and legislative policy. Then, the choice of cases for interventions to be carried out, with cases of family conflict that were under the responsibility of the Nucleus of Legal Practice (NPJ) of the Federal University of Pará (UFPA) being selected; the Court of Justice of the State of Pará (TJPA) of Belém, through the 4th and 5th Family Courts; Permanent Nucleus of Consensus Methods for Conflict Resolution (NUPEMEC), and the Judiciary Center for Conflict Resolution and Citizenship (CEJUSC) of the Capital and Ananindeua, totaling 14 interventions. Which followed the following steps: pre-circle, peace-building circle and post circle, when possible. After analyzing the interventions, the results were: five fully restorative cases; four partially restorative cases; and five non-restorative cases. Given the above, it is observed that the resolution of family conflicts through Restorative Justice is fully possible and even recommendable, providing the actors involved with the opportunity to reach a consensual, humanized and democratic solution, based on dialogue and active listening , enabling a safe environment for the discussion of difficult and painful matters that meets the needs of the parties, generating obligations in relation to the damage caused, making them assume their responsibilities. Os conflitos familiares são complexos e estão crescendo de forma escalonada relacionados a diversos aspectos, como psicológicos, comportamentais, morais, culturais e econômicos, acarretando a massificação da judicialização em virtude de os atores envolvidos não conseguirem chegar a uma resolução consensuada. Este fato ainda gera a possibilidade de outras condutas advindas da ausência deste consenso com consequências, inclusive de caráter criminal. Esta pesquisa objetivou verificar a possibilidade de aplicabilidade de Justiça Restaurativa nas conflitualidades de Direito de Família judicializadas ou não, observando suas especificidades para que a abordagem metodológica fosse aplicada de forma satisfatória. Como metodologia optou-se pela pesquisa empírica qualitativa com enfoque hermenêutico. Na fase das intervenções de justiça restaurativa nos casos concretos, aplicou-se o método do círculo de construção de paz, conforme metodologia descrita por Pranis (2011). Primeiramente, realizou se um levantamento bibliográfico-documental a respeito de justiça restaurativa, aos conflitos familiares, às práticas restaurativas, aos projetos e à política legislativa. Em seguida, a escolha dos casos para que fossem realizadas as intervenções, sendo selecionados casos de conflito familiar que estavam sobre responsabilidade do Núcleo de Prática Jurídica (NPJ) da Universidade Federal do Pará (UFPA); do Tribunal de Justiça do Estado do Pará (TJPA) de Belém, através da 4ª e 5ª Vara de Família; Núcleo Permanente de Métodos Consensuais de Solução de Conflitos (NUPEMEC), e do Centro Judiciário de Solução de Conflitos e Cidadania (CEJUSC) da Capital e de Ananindeua, totalizando 14 intervenções. As quais seguiram as seguintes etapas: pré-círculo, círculo de construção de paz e o pós-círculo, quando possível. Após a análise das intervenções, tivemos como resultado: cinco casos totalmente restaurativos; quatro casos parcialmente restaurativos; e cinco casos não restaurativos. Diante do exposto, observa-se que a resolução de conflitualidades familiares por meio de Justiça Restaurativa é plenamente possível e até recomendável, proporcionando aos atores envolvidos a oportunidade de chegar a uma solução consensuada, humanizada e democrática, com base no diálogo e na escuta ativa, possibilitando um ambiente seguro para a discussão sobre assuntos difíceis e dolorosos que atenda às necessidades das partes, gerando obrigações em relação aos danos causados, fazendo com que assumam suas responsabilidades. 2023-04-06T14:52:08Z 2023-04-06T14:52:08Z 2021-09-14 Tese SOARES, Cynthia Fernanda Oliveira.
