To do so, demonstrate, primarily, that the observance of good faith in its objective feature is not restricted to civil diploma materials, especially form the objective good faith an ethical value basis in constitutional law, spreading therefore throughout the Brazilian legal system, including the legal relationships procedural. Moreover, it will verify that the objective good faith is expressed in the Brazilian Code of Civil Procedure, which provides for duties of loyalty and cooperation among all subjects of the process, which, however, is not sufficient for its realization in the process, necessitating the application of preventive and repressive measures for its observance. In this vein, it is shown the important role of the Judiciary in conducting the process in order to adapt it to the peculiarities of the case, according to social morality, seeing mainly a fair decision. Thus, the context in which it develops good faith is the Neoprocessualism, where the process is seen as an instrument for achieving good faith, morality, honesty and loyalty, representing a symbiosis between the ethical values and legal principles in the pursuit of realizing the right material. O presente trabalho tem por objetivo analisar a aplicação da boa-fé objetiva no âmbito do direito processual civil brasileiro. Para tanto, demonstrará, precipuamente, que a observância da boa-fé na sua feição objetiva não se restringe ao diploma material civil, especialmente por constituir a boa-fé objetiva um valor ético com fundamento na Lei Fundamental, espraiando-se, por conseguinte, por todo o sistema jurídico brasileiro, inclusive nas relações jurídicas processuais. Ademais, verificar-se-á que a boa-fé objetiva encontra-se expressa no Código de Processo Civil brasileiro, que prevê deveres de lealdade e cooperação entre todos os sujeitos do processo, o que, entretanto, não é suficiente para a sua efetivação no processo, sendo necessária a aplicação de medidas preventivas e repressivas para a sua observância. Nesse diapasão, mostra-se importantíssima a atuação judicial na condução do processo, a fim de adaptá-lo às peculiaridades do caso concreto, de acordo com a moral social, vislumbrando, sobretudo, uma decisão justa. Desse modo, o contexto em que se desenvolve a boa-fé é o do Neoprocessualismo, no qual o processo é visto como um instrumento de concretização da boa-fé, da moralidade, da honestidade e da lealdade, representando uma simbiose entre os valores éticos e os preceitos legais, na busca da concretização do direito material. 2017-01-23T13:21:38Z 2017-01-23T13:21:38Z 2013-02-07 Dissertação LEVY, Karine de Aquino Câmara.
