In the pursuit of this objective, a qualitative bibliographic search was used, seeking the most important and updated information on the topic. Aiming at this objective, the work was divided into three chapters: at first, it was treated about the current Brazilian scenario on the issue of solid waste, the national policy implemented with Law 13.305 / 2010 and its definitions, in a second moment, the implementation of the PNRS, the history of the Aurá dump, its closure and the social problem caused, ending with the conduct adopted by the Public Ministry in an attempt to resolve the case. Law 12,305 of 2010 implemented in Brazil the National Solid Waste Plan aiming at the correct destination of the waste generated in the most diverse means, focusing on objectives such as non-production, reduction of waste, reuse, recycling and final disposal in an environmentally correct location for this purpose. end. The law made it mandatory to close the dumps around the country, including the Aurá dump, one of the largest in activity at the time. However, in order for the provisions to be met, there was a need to establish a Term of Conduct, formulated by the Public Prosecutor of Pará, allowing time for the city halls of the metropolitan region of Belém to adapt to the rules of the current legislation, something that until the present date has not been fully realized. O presente trabalhou procurou trazer uma análise sobre o Termo de Ajustamento de Conduta, relatando o caso ocorrido com o fechamento do lixão do Aurá e o problema ainda existente na região metropolitana de Belém sobre a correta destinação e tratamento dos resíduos sólidos. Na busca desses objetivos, utilizou-se de pesquisa bibliográfica de cunho qualitativo, buscando o que de mais importante e atualizado se encontrou sobre o tema. Visando esse objetivo o trabalho foi dividido em três capítulos: em um primeiro momento foi tratado sobre o panorama atual brasileiro, relatando a questão dos resíduos sólidos, a política nacional implantada com a Lei 13.305/2010 e suas definições, em um segundo momento, a implementação das PNRS, o histórico do lixão do Aurá, seu fechamento e o problema social causado, finalizando com a conduta adotada pelo Ministério Público na tentativa de resolução do caso. A Lei 12.305 de 2010 implantou no Brasil o Plano Nacional de Resíduos Sólidos visando a correta destinação do lixo gerado nos mais diversos meios, focando em objetivos como a não produção, diminuição do lixo, reaproveitamento, reciclagem e destinação final em local ambientalmente correto para esse fim. A lei tornou obrigatório o fechamento dos lixões espalhados pelo país, entre eles o lixão do Aurá, um dos maiores em atividade à época. Porém para que os dispositivos fossem cumpridos existiu a necessidade da instauração de um Termo de Conduta, formulado pelo Ministério Público do Pará, concedendo tempo para que as prefeituras da região metropolitana de Belém se adequassem ás normas da legislação vigente, algo que até a presente data não foi totalmente realizado. 2022-11-21T17:40:36Z 2022-11-21T17:40:36Z 2020-12-10 Trabalho de Conclusão de Curso - Graduação RIBEIRO, César Augusto Lopes.
