Resumo:
This monograph is developed in order to verify whether the behavior of the Federative Republic of Brazil on the last four years violates cooperation and collaboration recommended by article 205 of the Federal Constitution for promotion of education and related rights. For this purpose, it was initially sought to understand the relevance and importance, social and legal, of education for society. To achieve this, the legal regime determined by the Federal Constitution for the right to education was explained, basing the analysis in this work on articles 205, 206 and 208 of the constitutional document. After that, only the content of article 205 was analyzed, which, as a programmatic norm, recommends cooperation and association between the responsible entities for promoting education, simultaneously verifying whether other normative provisions, of the Federal Constitution itself or of the Law of Directives and Bases of Education, defined an ideal model for the relationship of Public Power and private institutions. At last, there was an analysis of the topic of education during the period 2016 - 2020, more specifically during the presidential term of Michel Temer, from 2016, and Jair Bolsonaro, since 2019. Therefore, it was noticed that there is a progressive disruption with the participatory spirit proclaimed by article 205, due to the execution or attempt to execute policies that, instead of expanding the right to education, result in its dismantling and disarticulation. To achieve the purposes of this monograph, the methodology used was bibliographic research, through the deductive method.
