Thus, the hereditary right emerged and the alteration of whose by his successors in the legal relations in which he was part. The present work aims to deal specifically with succession planning, as well as its importance within inheritance law, analyzing it from the point of view of donation. For this, it is based on a bibliographic review, considering that, through this research technique, it is possible to recover knowledge already systematized in a certain area. In this sense, research was sought in legislation and doctrine that could support the discussion proposed here. In view of all that has been mentioned, it should be concluded that the donation institute, within civil legislation, must be seen as a legal instrument, which aims to assist in the implementation of succession planning. However, for this to become a reality, it is necessary that this instrument be handled correctly, within the legal boundaries in accordance with the doctrine and, also, in line with the jurisprudence. In this sense, it is also worth mentioning that the donation institute is one of the most effective instruments, since it is a type of contract provided for in the Civil Code of 2002, which means that the donation is an instrument arising from the will of the donor and the donee, of an agreement between them. And, generally, this contract consists of the assumption of an obligation by the donor, who commits to the delivery of the good that will be donated, and the reception of this good by the donee. O Direito das Sucessões regula a partilha de bens e a herança, criando e modificando normas que são empregadas no curso da sucessão, que somente ocorre com o falecimento do de cujus, ou quando se presume o falecimento deste. Surgindo, desse modo, o direito hereditário e advindo a alteração do de cujos pelos seus sucessores nas relações jurídicas em que fazia parte. O presente trabalho tem como objetivo tratar especificamente do planejamento da sucessão, bem como de sua importância dentro do direito sucessório, analisando-o a partir do instituto da doação. Para isso, se baseia em uma revisão bibliográfica, haja vista que, por meio dessa técnica de pesquisa, é possível recuperar conhecimentos já sistematizados em determinada área. Nesse sentido, foram buscadas pesquisas na legislação e na doutrina que pudessem sustentar a discussão aqui proposta. Diante de tudo que foi mencionado, cabe concluir que o instituto da doação, dentro da legislação civil, deve ser observado como sendo um instrumento jurídico, que tem como objetivo auxiliar na implementação de um planejamento sucessório. Porém, para que isso seja uma realidade, é necessário que esse instrumento seja manejado de forma correta, dentro dos liames legais em conformidade com a doutrina e, também, alinhado com a jurisprudência. Nesse sentido, também cabe mencionar que o instituto da doação é um dos instrumentos mais efetivos, visto que é espécie de contrato prevista no Código Civil de 2002, o que significa dizer que a doação é um instrumento oriundo da vontade do doador e do donatário, de um acordo entre eles.
