The present study deals with the social relations that are formed in the virtual sphere, in order to understand the arguments raised by judicial authorities to hold digital influencers responsible, when they use the right to freedom of expression to promote virtual lynching and violate the right to integrity morals of legal persons. For that, it was necessary to understand not only the freedom of expression of digital influencers in the virtual environment, but also the consequences of the “cancellation” of companies, an expression used to characterize the set of virtual attacks directed at a certain user. A bibliographical research on the subject was then carried out, as well as the study of cases in which digital influencers were held responsible for promoting the virtual lynching of legal entities, in order to understand the legal understanding. In view of this, it was verified that the guarantee of freedom of expression is necessary for the promotion of the democratic state, however, when exercised in a way that violates other personality rights, mainly, by influencers in their digital channels when they stimulate the culture of cancellation to reach legal entities, this causes damage to the image and honor, in an exponential way. A internet deixou de ser apenas um instrumento de comunicação e passou a integrar a realidade das pessoas, influenciando escolhas e moldando opiniões. O presente estudo trata das relações sociais que se formam na esfera virtual, a fim de compreender quais os argumentos suscitados por autoridades judiciárias para responsabilizar influenciadores digitais, quando estes utilizam o direito à liberdade de expressão para promover o linchamento virtual e violar o direito à integridade moral de pessoas jurídicas. Para tanto, foi necessário compreender não apenas a liberdade de expressão dos influenciadores digitais no meio virtual, mas também as consequências do “cancelamento” de empresas, expressão utilizada para caracterizar o conjunto de ataques virtuais direcionados a determinado usuário. Realizou-se, então, uma pesquisa bibliográfica sobre o tema, bem como o estudo de casos em que influenciadores digitais foram responsabilizados por promoveram o linchamento virtual de pessoas jurídicas, a fim de compreender o entendimento jurídico. Diante disso, verificou-se que a garantia da liberdade de expressão é necessária para a promoção do estado democrático, todavia, quando exercida de modo a violar outros direitos da personalidade, principalmente, por influenciadores em seus canais digitais quando estimulam a cultura do cancelamento para atingir pessoas jurídicas, esta ocasiona danos à imagem e à honra, de forma exponencial. 2023-11-30T14:34:33Z 2023-11-30T14:34:33Z 2023-06-29 Trabalho de Conclusão de Curso - Graduação - Artigo LIMA, Ana Paula Ferreira de.
