Adoption in Brazil is procedurally complex and influenced by a range of socioeconomic and cultural factors that, at times, negatively impact the effective right to family coexistence of children and adolescents. This study aimed to analyze how legal, social, and psychological obstacles impact this right. The investigation seeks to answer the question: what are the socioeconomic and cultural factors involved in adoption in Brazil and how do they impact the right to family coexistence of children and adolescents? The methodology employed was of a qualitative, descriptive, and bibliographic nature, undertaking an extensive literature review on the topic. The findings indicated that, despite existing legislation, there are several legal barriers that hinder the adoption process. Additionally, social prejudices, stigmas associated with adoption, and cultural factors play a crucial role in the decision to adopt or be adopted. The research also revealed the need for adequate psychological resources to support both children and adolescents as well as adoptive families, promoting healthy adaptation and enduring bonds. In conclusion, the right to family coexistence, although legally supported, faces significant practical challenges in the Brazilian context. It is imperative to recognize and address these challenges to ensure that all children and adolescents have the opportunity to live in a loving and supportive family environment, regardless of their origin or circumstances. O direito à convivência familiar é uma prerrogativa fundamental da criança e do adolescente. No Brasil, este direito é amparado pelo Estatuto da Criança e do Adolescente (ECA), mas sua efetivação passa por desafios multifacetados no contexto da adoção. A adoção no Brasil é processualmente complexa e influenciada por uma variedade de fatores socioeconômicos e culturais que, por vezes, impactam negativamente a efetividade do direito à convivência familiar de crianças e adolescentes. Este estudo teve como objetivo geral analisar como os obstáculos legais, sociais e psicológicos impactam o referido direito. A investigação busca responder ao problema: quais são os fatores psicológicos, socioeconômicos e culturais envolvidos na adoção no Brasil e como impactam no direito à convivência familiar de crianças e adolescentes? A metodologia adotada foi de natureza qualitativa, descritiva e bibliográfica, realizando uma revisão de literatura extensiva sobre o tema. Os resultados indicaram que, apesar das legislações existentes, há uma série de barreiras legais que dificultam o processo de adoção. Adicionalmente, preconceitos sociais, estigmas associados à adoção e fatores culturais desempenham um papel crucial na decisão de adotar ou ser adotado. A pesquisa também revelou a necessidade de recursos psicológicos adequados para apoiar tanto as crianças e adolescentes quanto as famílias adotivas, de modo a promover uma adaptação saudável e vínculos duradouros. Em conclusão, o direito à convivência familiar, embora amparado legalmente, enfrenta desafios práticos significativos no contexto brasileiro.
