Resumo:
The Term of Reference (TR) is an essential document to ensure efficiency and transparency in public procurement, contributing to the proper allocation of resources and competitiveness in contracting processes. This study analyzed the impacts of TRs on the dynamics and outcomes of public tenders, highlighting their relevance in specification clarity, promoting supplier participation, and improving the quality of proposals received. Through a qualitative approach and document analysis of manuals, legislation, and case studies, the research identified challenges related to TR drafting, such as the lack of standardization, staff training, and balance between flexibility and specificity. The results indicate that well-prepared TRs enhance competitiveness and efficiency, while vague or overly restrictive documents compromise transparency and contractual execution. The study presents recommendations to improve TR drafting, including training programs, market consultations, and standardized templates.
