In this direction, bibliographic research allied with documentary analyses, interviews, questionnaires and observations, made during the field activities, provide access to necessary informations. Based on the concept of the territory as category of analysis, in case of a double presumption involving the Monte Roraima National Park and the Amerindian’s Land Raposa Serra do Sol in the state of Roraima, is utilized to support to the discussions in three principle focus. The first one points to the identification and analysis of conflicts from environmental and indigenous rights. One of the issues crucial to the arisen the tensions, including the inexistence of specific normality for the overlapping areas. In these conditions, the determinations of the environmental legislation finds resistence in the Amerindian rights. The second approach shows that the conflicts are disagreements of interests between the states and Amerindian territorialities. Even though the tensions remains stable, in virtue of the abstract ownership practiced by the National State, inclines to elevate due to manifestation of intentions of physical implementation of the National Park. The third approach concentrates the approaches in the conflicts resulting from the negotiation processes. The restrictions made the negotiations difficult partnership establishments, leading to the development of an instrument of management of conflicts able to contain different interests, permitting free practice autonomy of the subjects involved. The analysis permits the confirmation that the conflicts due to the creation of the National Park in Amerindian territory, related to the questions approaches in the theory, can be faced from the proposition of guidelines for the overlapping cases cited. This way, the interests of the Amerindians of physical reproduction and cultural can be united to the state’s interest on the Management Plan of the National Park. Such possibility can permit the establishment of negotiation process able resulting in accordance and partnership, contributing signifies to manage the conflicts in the territory studied. Com o intuito de construir uma reflexão a respeito das sobreposições territoriais, o presente estudo prioriza as análises dos conflitos decorrentes da criação de uma unidade de conservação de proteção integral em território indígena. Nesta direção, pesquisas bibliográficas aliadas a análises documentais, entrevistas, questionários e observações, realizadas durante as atividades de campo, propiciam o acesso às informações necessárias. Fundamentando-se no conceito de território como categoria de análise, o caso da dupla afetação envolvendo o Parque Nacional do Monte Roraima e a Terra Indígena Raposa Serra do Sol, no Estado de Roraima, é utilizado como suporte às discussões a partir de três enfoques principais. O primeiro deles aponta para a identificação e análise dos conflitos oriundos dos direitos ambiental e indígena. Dentre as questões determinantes para o surgimento das tensões, inclui-se a inexistência de normatizações específicas para as áreas sobrepostas. Nestas condições, as determinações da legislação ambiental encontram resistências nos contrastes com os direitos indígenas. Já o segundo enfoque trata dos conflitos decorrentes das divergências de interesses entre as territorialidades estatal e indígena. Embora as tensões permaneçam estáveis, em virtude da apropriação abstrata praticada pelo Estado Nacional, tendem a se elevar a partir da manifestação da intenção de implementação física do Parque Nacional. O terceiro enfoque, por seu turno, concentra as abordagens nos conflitos resultantes dos processos de negociação. As restrições impostas às negociações dificultam o estabelecimento de parcerias, suscitando o desenvolvimento de um instrumento de gestão de conflitos capaz de comportar interesses diversos e permitir o livre exercício da autonomia dos sujeitos envolvidos. As análises permitem afirmar que os conflitos decorrentes da criação do PNMR em território indígena, relacionados com as questões abordadas na hipótese, podem ser enfrentados a partir da proposição de diretrizes para os casos de sobreposição citados. Dessa forma, os interesses indígenas de reprodução física e cultural podem ser reunidos aos interesses estatais no Plano de Manejo do PNMR.
