The present dissertation aims to support the analysis and reflection carried out since the
completion of the undergraduate course, about the socio-educational measure of assisted liberty
(AL), and the ways in which its implementation and management has taken place in the
Brazilian reality Reflecting, therefore, on the promotion or retribution biases that permeate the
applicability of this measure. In this way, through bibliographical and documental research,
having as main focus, the Child and Adolescent Statute (ECA) – Federal Law nº. 8.069/1990
and the National Socio-Educational Assistance System (SINASE) – Federal Law nº
12.594/2012, as well as a survey of authors who corroborate the theme. We strive to reflect on
some categories that we understand are important for our reflection, such as: childhood,
children, youth and how all these can be specters and instruments for the construction and
perpetuation of an ideology in the figure of fear, which can serve as a guard. mor to perpetuate
the ruling class and its ultraneoliberal strategies. In this sense, we can reflect that this entire
ideology permeates the juvenile justice system, through socio-educational measures, which
contain at the core and in its aegis the concepts of retribution for the behavior practiced. In this
way, we will understand that because they are applied taking into account the axiologies and
analogies, they contribute greatly to the perpetuation of injustices and violation of rights. |
