The theme was approached from a legal, historical and sociological point of view, bringing a brief historical and social construction of the rights of children and teenager through the study of the categories of children and adolescence, going to the study of the institutionalization of the child in Brasil asylum from colonization to the advent of the Statute of the Child and Teenager (ECA), which establishes the Doctrine of Integral Protection and its guiding principles, in order to understand the legal purpose of these rights, now assured to these teenager. Subsequently, the Socio-educational Measure of Internment was studied, analyzing its legal nature and the social construction of punitive legal discourses of Teenager in conflict with the law, built over the years. By means of the survey of the data of teenager in conflict with the law in compliance with the Socio-educational Measure of Internment in the CSEBA, during the year of 2017, in the months of March to May, from the advisory cards of the teenager, as well as through the analyzes of the observations of the researcher of the daily routine of teenager, a socioeconomic profile of these teenager in conflict with the law can be highlighted. Based on the variables of the research, an econometric model was used as a means of observing the infraction acts practiced by the teenager in compliance with the Socio-educational Measure of Internationalization and their family, social and economic relationship, providing a critical reflection about the reality found in the Socio-Educational Center of the In the light of the criminal legal discourse, justifying their modes of action, aiming at this research, the contribution to search for coherent means and practices and socioeducational character referred to in child and adolescent protection legislation. Universidade Federal do Oeste do Pará A presente dissertação trata da análise da realidade encontrada na aplicação e execução de Medidas Socioeducativas de Internação no Centro Socioeducativo do Baixo Amazonas - CSEBA, localizado no Município de Santarém, estado do Pará, sob a perspectiva dos princípios orientadores do Estatuto da Criança e do Adolescente (ECA), bem como em consonância com as regras mínimas de atendimento para aplicação das medidas socioeducativas no Brasil, que garantem direitos e deveres mínimos, determinados pelo Sistema Nacional de Atendimento Socioeducativo SINASE, com base em regras internacionais, do qual o Brasil é signatário, como a Convenção dos Direitos da Criança de 1990. A temática foi abordada sob uma visão legal, histórica e sociológica, trazendo uma breve construção histórica e social dos direitos da criança e do adolescente por meio do estudo das categorias infância e criança, e adolescência, passando ao estudo da institucionalização da criança no Brasil desde a colonização até o advento do Estatuto da Criança e do Adolescente (ECA), que estabelece a Doutrina da Proteção Integral e seus princípios orientadores, de forma a compreender o propósito legal destes direitos, hoje assegurados a estes adolescentes. Posteriormente foi estudada a Medida Socioeducativa de Internação, analisando sua natureza jurídica e a construção social dos discursos jurídicos punitivos de adolescentes em conflito com a lei, construídos ao longo dos anos. Por meio do levantamento dos dados dos adolescentes em conflito com a lei em cumprimento de Medida Socioeducativa de Internação no CSEBA, durante o ano de 2017, nos meses de março a maio, a partir das fichas de acompanhamento dos adolescentes, bem como por meio das análises das observações do pesquisador da rotina diária dos adolescentes, pode-se destacar um perfil socioeconômico destes adolescentes em conflito com a lei. A partir das variáveis da pesquisa realizou-se um modelo econométrico como meio de observação dos atos infracionais praticados pelos adolescentes em cumprimento de Medida Socioeducativa de Internação e sua relação familiar, social e econômica, ensejando uma reflexão crítica acerca da realidade encontrada no Centro Socioeducativo do Baixo Amazonas, tendo em vista o propósito da Doutrina da Proteção Integral, por vezes, paradoxalmente, aplicados à luz do discurso jurídico penal, justificando seus modos de ações, tendo como objetivo desta pesquisa, a contribuição para busca de meios e práticas coerentes e que atendam ao caráter socioeducativo aludido na legislação de proteção à criança e o adolescente. 2021-02-25T02:43:59Z 2021-02-25T02:43:59Z 2018-12-15 Dissertation VASCONCELOS, Lívia Medeiros.
