For that, it is necessary to research the jurisprudence and make them dialogue with the doctrine. Then, a bibliographic and jurisprudential research is carried out, which uses the hypothetical deductive method so, based on the STJ's doctrine and jurisprudential decisions, it is possible to understand the judges' comprehension of the present theme. In view of this, it appears that the Brazilian doctrine, for the most part, recognizes the possibility of parents' civil liability in the face of their children's emotional abandonment. The STJ's jurisprudence, however, is not peaceful in relation to the theme, however, in the decision in which it recognizes the moral damage resulting from emotional abandonment, it is possible to observe that the STJ started to recognize the relevance of the principle of affectivity and its relationship with the duty of care, in the search for the State to protect the best interests of children and adolescents. Tendo em vista que o abandono afetivo tem sido tema cada vez mais presente nas discussões jurídicas e que tornou-se de grande relevância no direito de família, uma vez que atinge diretamente direitos fundamentais de crianças e adolescentes, sujeitos de direito em desenvolvimento, é importante pesquisar sobre os critérios que o Superior Tribunal de Justiça utilizou para caracterizar dano moral decorrente de abandono afetivo na relação paterno-filial, a fim de trazer à luz como a jurisprudência do STJ vem tratando o tema. Para tanto, é necessário pesquisar as jurisprudências e fazê-las dialogar com a doutrina. Realiza-se, então, uma pesquisa bibliográfica e jurisprudêncial, que se utiliza o método hipotético dedutivo para que, a partir da doutrina e das decisões jurisprudenciais do STJ, se possa compreender o entendimento dos julgadores do presente tema. Diante disso, verifica-se que a doutrina brasileira, em sua maioria reconhece a possibilidade da responsabilidazação civil dos pais em face do abandono afetivo dos filhos.
