This article will focus on thefinancial and social situation of Pará, which was one of the states most affected by the exemptions, and has an HDI with poor indexes, being also supported by a technical report produced by the TCE\PA, making the analysis of ADO 25 of the STF and with the help of some scholars of Brazilian fiscal federalism, who in unison agreed that although there was indeed an increase in Brazilian exports, the federative principle under which the new constitutional order was built was clearly scratched, since that the exemption policy that was undertaken by the Kandir Law, caused by the loss of tax revenues and compensations that proved to be insufficient, an imbalance in Brazilian fiscal federalism and a framework of underdevelopment in Pará, since there was no improvement in social indices of the state, even with the increase in exports from Pará, mainly of ores, in view of this situation it is possible to conclude that the legal provisions of the Kandir Law, although they were not the cause, contributed to the worsening of a situation of underdevelopment that already existed in Pará, in a federalism that turned out to be unbalanced. A Lei Kandir foi um instrumento legal pelo qual a União, ao promover a desoneração do ICMS das exportações de produtos primários e semielaborados, aumentou o saldo da balança comercial brasileira, contudo como os mecanismos compensatórios criados para repor as perdas que os estados que mais exportavam tiveram, se revelaram insuficientes, os efeitos de suas disposições legais acabaram por provocar um quadro de grande desigualdade regional, que contraria um dos objetivos fundamentais da República Brasileira. O presente artigo irá se debruçar sobre a situação financeira e social do Pará, que foi um dos estados mais afetados pelas desonerações, e possuidor de um IDH com índices ruins, sendo também amparado por um relatório técnico produzido pelo TCE\PA, fazendo a análise da ADO 25 do STF e com o auxílio de alguns estudiosos do federalismo fiscal brasileiro, que em uníssono concordaram que embora tenha havido sim um incremento das exportações brasileiras, o princípio federativo sob o qual a nova ordem constitucional foi construída foi claramente arranhado, uma vez que a política de desonerações que foi empreendida pela Lei Kandir, provocou com as perdas de receitas fiscais e compensações que se revelaram insuficientes, um desequilíbrio no federalismo fiscal brasileiro e um quadro de subdesenvolvimento no Pará, uma vez que não houve uma melhora nos índices sociais do estado, mesmo com o aumento das exportações paraenses, principalmente de minérios, diante desta situação é possível concluir que as disposições legais da Lei Kandir, embora não tenham sido a causa, contribuíram para o agravamento de um quadro de subdesenvolvimento que já existia no Pará, em um federalismo que se revelou desequilibrado. 2023-11-30T14:43:18Z 2023-11-30T14:43:18Z 2023-07-04 Trabalho de Conclusão de Curso - Graduação - Artigo LOPES, Ricardo Pessoa de Almeida.
