With this, the Supreme Court has the prerogative of linking its understandings of the provisions of law to other Brazilian Courts, building its jurisprudence for decisions. In this sense, the institute of parliamentary immunity underwent several interpretations and jurisprudential understandings of the Supreme Court. Last year there was a jurisprudential turnaround, caused by the raising of the Question of Order in the Judgment of Criminal Action 937 QO / RJ. This turn brought a constitutional change to the constitutional provision that guarantees the prerogative of the parliamentary forum. Given this, it is of great relevance to study the jurisprudential understanding of the Supreme Court, together with the impacts that this mutation has had on the republican system where, inductively, a general conclusion can be made through a basic research of the target object, namely the Supreme. Federal Court and its understanding of the institute of parliamentary immunity, because, as detailed during this article, this change has a direct impact on one of the Powers of the Republic, the Legislative, from which it has, theoretically, independence guaranteed by the principle of Separation Theory. of the Powers, also guaranteed by the Constitution, bringing up the problem. A Constituição Federal de 1988 deu ao Supremo Tribunal Federal a função de guardião e protetor da Carta Constitucional. Com isto, a Suprema Corte possui a prerrogativa de vincular seus entendimentos dos dispositivos de lei aos demais Tribunais brasileiros, construindo sua jurisprudência para as decisões. Neste sentido, o instituto da imunidade parlamentar passou por diversas interpretações e entendimentos jurisprudenciais do Supremo Tribunal Federal. No último ano aconteceu uma virada jurisprudencial, causada pela suscitação da Questão de Ordem no julgamento da Ação Penal 937 QO/RJ. Esta virada trouxe uma mutação constitucional ao dispositivo da Constituição que garante a prerrogativa de foro do parlamentar. Diante disso, é de grande relevância o estudo do entendimento jurisprudencial da Suprema Corte, juntamente com os impactos que esta mutação causou ao sistema republicano onde, indutivamente, pode ser feita uma conclusão geral através de uma pesquisa básica do objeto alvo, qual seja o Supremo Tribunal Federal e seu entendimento sobre o instituto da imunidade parlamentar, pois, conforme esmiuçado durante o presente artigo, esta mudança gera impacto direto em um dos Poderes da República, o Legislativo, do qual possui, teoricamente, independência garantida pelo princípio da Teoria da Separação dos Poderes, também garantido pela Constituição, trazendo à tona a problemática.
